Terms of Service

1. Agreement
These Terms govern your use of the websites, software, automation, artificial intelligence, consulting, and managed services provided by Desert PC Services ("DPC", "we", "our", or "us"). By using a service or accepting a proposal, you agree to these Terms and any written order, statement of work, or subscription plan.
2. Services and Accounts
You must provide accurate information, protect your credentials, and have authority to connect any website, social media account, data source, or third-party service you ask us to manage. You are responsible for activity performed through credentials or approvals under your control.
3. Acceptable Use
You may not use our services for unlawful, deceptive, abusive, infringing, malicious, or unauthorized activity; to distribute spam; to bypass platform safeguards; or to access data or accounts without permission. We may suspend activity that creates a security, legal, or platform-compliance risk.
4. AI and Automated Content
AI-generated text, images, audio, video, and recommendations may contain errors and require human review. Unless a written agreement states otherwise, you are responsible for approving public content and confirming its accuracy, rights, disclosures, and suitability before publication. Automated workflows may be paused when a provider or social platform changes its rules or availability.
5. Fees, Billing, and Refunds
Fees, currencies, payment schedules, usage limits, and cancellation terms are stated in the applicable proposal, checkout page, or subscription plan. Except where required by law or expressly agreed in writing, completed professional services and consumed third-party usage are non-refundable.
6. Intellectual Property
Each party retains ownership of materials it owned before the engagement. After full payment, you receive the rights described in the applicable written agreement for custom deliverables. DPC retains its pre-existing tools, templates, know-how, reusable components, and general automation methods. Third-party materials remain subject to their respective licenses.
7. Third-Party Platforms
Services may depend on providers such as Meta, Google, Stripe, cloud hosts, and AI vendors. Your use of those providers is also governed by their terms. We are not responsible for outages, account restrictions, policy changes, or discontinued APIs outside our reasonable control.
8. Privacy and Confidentiality
Our handling of personal data is described in our Privacy Policy. Each party will use reasonable care to protect the other party's non-public business information and will use it only to perform or receive the services.
9. Disclaimers and Limitation of Liability
Services are provided with reasonable professional care but without a guarantee of uninterrupted operation, specific revenue, rankings, engagement, or other business results. To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, or consequential damages. DPC's aggregate liability for a claim will not exceed the amount paid for the affected service during the three months before the event giving rise to the claim.
10. Termination
Either party may terminate as allowed by the applicable plan or written agreement. We may suspend or terminate access for material breach, non-payment, unlawful use, or an urgent security risk. Provisions that by their nature should survive termination will remain in effect.
11. Governing Law and Changes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. We may update these Terms by posting a revised effective date. Material changes will apply prospectively.
